Abstract

This paper seeks to analyze in a systematic way the legal arguments that justifies the admission of the indirect judicial review against the urban planning, when the directly opposed action is not an administrative act, but a plan that complements or develops the urban plan, that is to say, a general disposition linked with the norm indirectly contested by a relation of hierarchic subordination. The regulatory nature of the urban development plans, the hierarchic relation that presides normally at the relation between the instruments of planning, the own specificities of the planning, and the foundation of the indirect judicial review against the general dispositions, they constitute determinant factors in order to admit the mentioned judicial review.
