Abstract

The Government’s legislative initiative is subject in our system to a dense statutory regime that also includes legal provisions with the force of law. This legal discipline, however, has not prevented jurisprudence from upholding the judicial immunity of acts approving and submitting bills to Parliament. This paper examines the foundation of such judicial immunity, traditionally linked to the doctrine of politicalacts of the Government. Based on the results of this examination, the paper questions the rationale behind the legal discipline of the Government’s legislative initiative, as well as its effects on statute law as a source of law.
