Abstract

Council Framework Decision 2005/214/JHA of 24 February 2005 on the
application of the principle of mutual recognition to financial penalties was a decisive
step towards the cross-border enforcement of criminal and administrative traffic
decisions. However, the requirements laid down in the law to make this possible
have been interpreted as an insurmountable obstacle for Spain. This paper studies
the issue, analysing it from the doctrine of autonomous concepts and the case law
of the Court of Justice of the European Union. The aim is to provide solutions to
remedy a situation which has left Spain in an inequal position in relation with other
Member States, which damages the single market and the free movement of people
in the European Union.
