Abstract

The decarbonisation of the economy is key to achieving the objective of climate neutrality, as a basic approach in the fight against climate change. The Law on Climate Change and Energy Transition is committed to reversible pumping hydroelectric plants as a formula to achieve the integration of renewable energies into the electricity system and thus facilitate the energy transition towards this decarbonisation. However, pre-existing rights derived from other concessions for the use of the public hydraulic domain may be incompatible with the new concessions granted for that purpose. We analyse and assess these possible incompatibilities and the tools offered by the current legal system to avoid or eliminate them
