Abstract

In this paper, a rigorous characterisation of the so-called «principle of procedural autonomy» is proposed. It is argued that the «principle of procedural autonomy» is not a legal principle of EU law nor does it reflect a domain of competence reserved to the member states, as it happens in some federal states. The paper will review the legal character, the content and the conditions of operation of the «principle of procedural autonomy» of the member states when they implement EU law. In particular, it will nalyse the ECJ’s case-law on the accommodation of national procedural competence within the framework of EU law.
