Single-sex education faced with Spanish constitutional framework. A debate with multiple voices: legislation, legal scholars and case-law

Abstract

This paper critically analyzes the constitutionality of single-sex education and its financing with public resources, through agreements. To do this, it reviews the regulation —or its absence— of this type of education in the different and successive educational laws of our democracy, as well as the academic contributions and the main judicial decisions, both of the Constitutional Court and of the Supreme Court. If, after 2018 and the doctrine contained in the set of judgments that begins with the Constitutional Court Judgment 31/2018, the debate seemed closed, the changes introduced in the legislation by the LOMLOE (2020) have reopened it.
