Subsoil in town and country planning, a study of its legal dimensions

Abstract

The paper analyses the legal rulings handed down by the Supreme Court on the subject of subsoil as to town and country planning. Having gone into the standing regulations as to subsoil in the legislation governing hydraulic resources, public works, and ways, telephone networks, mines, the national historical heritage and urbanization works, the author elaborates a schematic table and short summary of all such legal decisions handed down by the Supreme court between 1900 and 1994 that have had any bearing on the subject of the subsoil, to then round the paper off with a more detailed study of each of the different issues upon which these rulings were made.
