Abstract

The paper first sets out to put the need for a reform in urbanistic legislation into its proper context, seeing this need to stem as much from the social and political consecuences of the 1976 Constitution as from the proper inadequacies of the legal system as such when faced by present day demands and social practice. Accepting the reforms undertaken by the present government to be justifiable, it then makes a critique of the focus given to these as to material competence, objectives and coherence. It finishes with an analysis of the key problems of present day urbanism, holding that these must be viewed by local government form a standpoint within a vew «territorial culture». Overall proposals along with concrete others and objectives are then sketched in so as to offer a congruent answer to that need for clarity, flexibility, simplification and adequacy that the social challenge demands.
