Effect of the New Law upon Civil Legislation and Mortgages (Property, Plots and New Buildings, etc.)

The author explains how the Registry for Property, which was originally set up to guarantee property ownership
and ease the transferring of this and in this aid credit and mortgaging activity, has with the passing
of time become one of the cornerstones to the property market’s efficient workings at all levels. Because
this is felt to be so, any law having a bearing upon this activity needs be not only fittingly drawn up
but also endowed with such means as would contribute to their being easily effective. The Registry of Property’s
duty to define and ensure property ownership carries with it an imperative overseeing of any process
touching upon its delineation and acquisition, this that there be no contravention of any imperative norm
that could mitigate against any third parties. This being so, the author is of the opinion that anything that
touches upon Town and Country Planning Law must —and ever more so— bear in mind the activity of the
Registry of Property.

With the aim of promoting the dissemination of knowledge, CyTET joins the Open Journal Access (OA) movement and delivers all of its content to various national and international indexes, repositories and databases under this protocol; therefore, the submission of a work to be published in the journal presupposes the explicit acceptance by the author of this distribution method.
Authors are encouraged to reproduce and host their work published in CyTET in institutional repositories, web pages, etc. with the intention of contributing to the improvement of the transfer of knowledge and the citation of said works.
