Abstract

The article considers those principles and rights recognised as to land, its ownership and usage by the
Spanish Constitution and which should thus be the inescapable grounding for the drawing up of any
legislation as to these particulars. To do so, the author suggests a close reading of how that Magna Charta
deals with the question of the use to which ground is put but this within the context of its article guaranteeing
the right to an access to and the usufruct of a decent and sound quality of housing and those others that touch
upon what he chooses here to call “The Environmental Constitution”. He then goes on to consider how the
Constitution furthers notions such as social cohesion and the opening up of the way to housing for all by setting
aside ground for socially subsidised housing or making it possible for government to benefit from the profits
of the market in this essential commodity.
