Estados Unidos de América: Líneas básicas de su legislación urbanística
Abstract
El urbanismo norteamericano es a menudo citado acríticamente como ejemplo de una actividad libérrima en la patria
del «wild west», paradigma de la apropiación ilimitada de recursos inmobiliarios inagotables, exenta de control
gubernamental o administrativo. La realidad no puede estar más alejada de esta estampa bucólica, pues el
gobierno jurídico del urbanismo norteamericano nos sorprende por su carácter complejo, y por asumir y resolver
con carácter de vanguardia problemas transversales apasionantes. Como en otros sectores del Derecho, la experiencia
norteamericana rotura el barbecho de la normatividad, enfrentándose a problemas que luego se actualizan
en otras latitudes. Aspectos como el exhaustivo análisis económico y financiero de las actuaciones urbanísticas,
que trascienden nuestro tradicional y pacato principio de «equidistribución» y exigen que el promotor sufrague
los costes o externalidades inherentes a la reforma o ampliación de las infraestructuras públicas generales pre-existentes,
fuera de los límites físicos de la actuación (off-site improvements); la interacción entre el urbanismo y la libertad
de expresión o la libertad religiosa; la tensión entre actividad urbanística y la segregación étnica y racial
(gated cities), etc. La lectura de las sentencias de los tribunales norteamericanos recaídas en asuntos urbanísticos,
motivados por un cuerpo de litigantes beligerantes, nos descubre de manera fresca y pragmática una relación
viva e íntima entre el urbanismo y estas cruciales cuestiones.
Son todos ellos ejemplos que nos muestran que el derecho urbanístico norteamericano, lejos de ser una selva de
pioneros armados, anclada en un liberalismo abstencionista, es un sistema global, avanzado, técnicamente sofisticado
e integrador de las exigencias ambientales, del que pueden extraerse, si no soluciones concretas, dada la diversidad
de los contextos jurídicos, sí al menos la inquietante percepción de preocupaciones y fronteras futuras.
