Abstract

This essay highlights the contributions Mauro Cappelletti made to comparative constitutional procedural law. It analyses his work from his first book (1955) on the constitutional jurisdiction of liberty, to his internationally relevant collected works on access to justice. Starting with a sketch of his life and the influence of Piero Calamandrei on his thought, the article explains how he used comparative law as a system of study. is contributions to constitutional justice are worth analysing from various angles: a) classification of constitutional jurisdictions; b) supranational constitutional justice; c) judicial control of the constitutionality of laws, from the remote past to modern times, when this has become obligatory practice; d) development of judicial review of legislation and concentrated control; e) convergence of both systems and f) the powers of constitutional judges and their democratic legitimation, amongst other aspects.
