¿Es inconstitucional la Resolución de la Cámara de Senadores de Paraguay que no confirma en sus cargos a los Ministros de la Corte Suprema de Justicia?

Abstract

The alleged institutional crisis between the Chamber of Senators and the Supreme Court of Justice of Paraguay results from the misinterpretation of the Paraguayan Constitution, particularly of the terms «magistrado» and «ministro» and of their irremovability. The Chamber of Senators dictated, on April 12, 2012, a resolution stating that the Justices of the Supreme Court would not be renovated in their offices, which immediately generated all sort of reactions claiming its unconstitutionality. In this article, we analyze this constitutional crisis, offering a study of the pertaining constitutional dispositions and of the resolutions dictated by the institutions involved. We also indicate possible answers to the problem, in accordance with the constitutional guidelines.
