Abstract

The paper attempts to address the issue of constitutional justice in order to overcome the historic American and European models, presenting the argument that each  model of constitutional justice is different from another: that could happen even if two models may have common characteristics and be similar to those historical. Different legal traditions and cultures made will influence the characteristics of constitutional justice in different Countries of the World. From this point of view, we wonder if there are basic elements that do not vary in some different systems of constitutional justice and how it can help our analysis the use of functional method of comparative law.
