Surrogacy in Spain and in the United Kingdom

Abstract

Surrogacy arrangements are prohibited under Spanish law. However, once those contracts have been properly concluded in other States in accordance with their Laws, it is possible to recognize that filiation in Spain, provided that certain conditions are met. In view of social reality, a regulation allowing surrogacy in Spain, will have to be carried out, sooner than later. The regulation of surrogacy arrangements in the United Kingdom will therefore be examined, sinceconcerning parenthood it considers legal bases similar to those of Spanish law, and an altruistic surrogacy model such as that of the United Kingdom could be articulated on them
