Applicable law on the European Proposal on Parenthood under the new family models

Abstract

The Proposal for a Regulation on Parentage has chosen to include a complete regulation of private international law, including rules on applicable law. This paper aims to carry out an analysis of a peculiar conflict rule, specially designed for a limited group of problems and groups, although generally applicable. For this, the structure of the conflict rule, its internal functioning and connection points are analyzed, as well as the special incidence that public order has in this matter.
