The Council Regulation (EU) 2016/1104 in matters of the property consequences of registered partnerships and unmarried couples in the Basque Country

Abstract

The endorsement of the European Regulation on the patrimonial effects of registered partnerships reveal again the problems arising from the non–attendance in the Spanish legal system of a material and conflictual regulation on unmarried couples. This paper analyses which law is applicable when the European instrument refers to Spanish law to confront the plurality laws derived from the legislative activity at the Autonomous Communities. Specifically, we will examine what possibilities exist to applying the Basque Law on unmarried couples and which options are agree with the basics principles underlying this field
