The role of a future Senate: questions resolved in the Council of State report

Abstract

The enhancement of the territorial powers of the Spanish Senate is one of the main objectives of the proposed Constitutional Reform. This paper reviews the proposals tabled by the Council of State (Consejo de Estado) in its 2006 Report regarding the different powers of the Upper Chamber. The report deals with (i) the Senate’s lawmaking powers, and proposes to enhance its role in the legislative procedures regarding all Bills of regional relevance, (ii) the Chamber’s powers on Treaty authorisation, (iii) the need to transform the Senate in a forum to seek agreements and cooperation between Autonomous Communities, and (iv) the Upper Chamber’s powers regarding other Constitutional Institutions. The final part of the paper deals with the institutional position of the Senate resulting from the report’s proposed composition and powers, which is considered as cautious and unfavourable to experimental innovations, although it could have been more daring in some aspects.
