Abstract

This paper analyses the freedom of association for judges, focusing both on the right to form judges’ professional associations and on the right to join non-professional organizations. One concludes that there are significant discrepancies between the original intent of the lawmaker when defining the statutory framework of the judiciary (namely pretending a neutral and independent judge) and the reality. Judges’ associationism has played a relevant role in such state of play. The paper focuses also in the experiences of judges’ associationism in a number of countries of equivalent democratic traition.
