The European Artificial Intelligence Act: Market Guarantee or Defense of Rights?

Abstract

Once the AI Act has been passed and some of its requirements are already in force, we should analyze both its approval process and its final outcome. It was a complex initiative which tried to reconcile the establishment of a uniform legal framework for the development, placing on the market, the putting into service and use of artificial intelligence systems with a high level of protection of health, safety and the rights enshrined in the European Charter of Fundamental Rights, including democracy, the rule of law and the protection of the environment. The following lines will describe the approval process and critically examine the extent to which this ambitious goal of simultaneously protecting the market and fundamental rights has been achieved in practice.
