El «tradicionalismo»: alcance y riesgos del último estándar de interpretación constitucional de la Corte Suprema estadounidense en materia de derechos

Abstract

The new “super-majority” of conservative judges of the North American Supreme Court has adopted, since 2020, a new standard of constitutionality, “traditionalism”, and with it has repealed the protection of the right to abortion in force for American women during half a century; has reduced the possibility of restricting the use of firearms; has limited the ability of government agencies to protect public health, safety, and stop climate change; and has declared unconstitutional the affirmative action measures traditionally used by American universities to ensure equality based on race. This regression in terms of fundamental rights is caused by the application of the “history and tradition” test. This article is dedicated to the
analysis of this and the consequences and risks of its application.
