Abstract

The proliferation of Israeli settlements in the West Bank is one of the main stumbling blocks to move the peace process forward, insofar as it constitutes a serious violation of International Humanitarian Law. While the European Union excludes from the scope of application of the association agreement with Israel the products originating in the settlements, and for this it has developed different measures notably the labelling, there is a debate about the fulfilment of the international obligations of the European Union and its Member States on this phenomenon. This paper aims to shed light on this issue, where International Humanitarian Law, international responsibility and the European Law does not always interact harmoniously.
