Minima moralia: the rule of law, the community method and the union budget

Abstract

Against the doubts about the role of the Union as regards the protection of the
rule of law, one should understand that this value has been essential for European
integration, since its inception, and that the Union should be able to protect it with
effective means, to preserve its own integrity as a Union based on the rule of law. The
understanding of Article 7 TEU as the exclusive procedure for the protection of fundamental
Union values is incorrect. The Union can protect its budget through legislative
measures against the impact or risks of breaches of the rule of law. At the same
time, the crisis of the Community method and the intergovernmental tendencies of
the Union remain in tension with the possibility of effective action in this field.
