Abstract

The present article examines the ruling issued by European Court of Justice on 14th April 2015. This decision rules the action for annulment initiated by the Council of the European Union against the European Commission referred to Commission’s decision to withdraw a proposal within the framework of the first reading stage of the ordinary legislative procedure. The ruling recognizes the right of the Commission to withdraw its proposal. This pronouncement reinforces the position of the Commission face to the Council of the European Union and the European Parliament.
