Abstract

Considering the position of the ECJ in Commune d’Ans, where the compatibility with EU Law of a blanket ban on the use of religious symbols by public servants enacted by a city hall was at stake, this paper discusses two issues in the field of Law and Religion that are pending clarification in European Union Law. On the one hand, whether religion and beliefs constitute a single ground of protection; on the other hand, the scope of the autonomy recognized by European Law to member states to decide their model of relationship towards religion
