The adoption of sanctions against Russia for the war in Ukraine

Abstract

The war in Ukraine has dragged on since 2014, causing an unprecedented humanitarian crisis, loss of life and significant political and economic instability in the region. However, its effects have not been limited to Ukraine alone: the impact of
the war on EU law and policy has been profound and far-reaching, as the EU has continued to base its response on law as the guiding principle and most effective tool to address the challenges arising from the war. In this context, sanctions represent one of the most effective legal instruments to address Russia’s aggression against Ukraine, but also one of the most complex, as their design, adoption and enforcement raise numerous legal issues. This article outlines the basic legal regime applicable to sanctions and how the EU is addressing, on the basis of the rule of law, the legal difficulties associated with their application.
