Abstract

This article examines the protection of sexual minorities’ rights within the European integration process, focusing on the legal provisions contained in the primary and secondary EU law, as well as on the relevant case law of the Court of Justice of the European Communities. The article ascertains the emergence of an incipient legally binding system for the protection of the rights of sexual minorities at Community level, especially since the Treaty of Amsterdam entered into force, which provided the European Union with a new legal basis to combat discrimination on grounds of sexual orientation.
