«Consultas populares» y «Referéndum consultivo»: una propuesta de delimitación conceptual y de distribución competencial.

Abstract

According to art. 149.1.32ª CE, authorization to call a referendum is an exclusive State competence. This partially illustrates, once again, the distrust on direct Democracy tools that exists in the Spanish Constitution. With this scenario in mind, a distinction between «consultas populares» and «referéndum consultivo» has been attempted to be introduced, thus trying to avoid the mandatory State authorization. This paper describes the distribution of competences between the State and the Autonomous Communities in this field, taking into special consideration the recent amendments to regional Statutes for Catalonia, Andalusia and Aragon, and delves into the concepts of «consultas populares» and «referéndum consultivo », rejecting the supposed consequences stemmed from this distinction.
