Abstract

Regulations on administrative intervention in firms suffer from relevant inaccuracies in our current body of law. Current cooperative regulations are not an exception. In this context, in addition to the problem that there is an excessive number of regional acts aimed to rule cooperative firms, which are repetitive and outdated, we find that intervention is not considered in all of them and, furthermore, that the application of these regulations significantly varies from one region to another. This paper tries to highlight the aforementioned undesirable inaccuracies, which should be solved since intervention is a key element which may have serious effects on trade and business freedom, which is a core right established by the 1978 Spanish Constitution.
