Abstract

Spanish Water Law focuses mainly on public domain, whose legal treatment was deeply refomed by the 1985 Water Act, specially when it named groundwater as a public good. This article studies a recent Suprem Court case-law on some wetlands called «Lagunas de Ruidera», which had been so far considered as a private property separeted from the Guadiana river. This declaration of their belonging to the public domain poses new effects on both their environmental and public management.
