Abstract

This article examines de role of the public and private sectors in the protection of biodiversity, the obligation to compensate for damages caused to habitats and species as required by the Habitats and Environmental Liability directives, and conservation banking. This mechanism raises a series of questions such as the need for public rules setting out its basic features and, in particular, the criteria according to which credits may be generated and subsequently employed to compensate for likely damages on habitats and species. In this particular respect, the article analyses Law 21/2013, on environmental assessment, which sets out certain broad rules concerning conservation banking.
