Abstract

This paper studies the Spanish Act (2007) about public procurement, three years after it is in force. The paper analyzes critically the Act and explains some problems appeared in its development: the creation of public companies to make contracts in spite of local authorities; the public procurement categories; the procedures of award; the standards used as award of contracts; the enforce of public procurement acts to urban development; the payments of the price of the contracts. The Act has been reformed in many times, mainly in the two last years, again because of the European Union. The first reform is about the special appeals in public procurement; and the Act of 2010 has created a new administrative Court to judge them. The second reform in 2011 about the contracts modification pursues to reduce this practice.
