Abstract

This article refers to the institutionalization process of the privately owned televisions and radios, prior to the «Ley General de Comunicación Audiovisual». It analyzes the laws and their economic context and it outlines certain aspects of the regulation and of the conflictive enforcement thereof that have been detrimental for the free competition or for the pluralism of the media. Specific criticisms are addressed to such issues as: the lack of a general regulatory model for these sectors, the shortcomings of the legal status of the licensee companies, the failed attempts to enlarge the television supply, sometimes carried out by publicly owned or recently privatized companies, the rules enacted in their advantage, and other important matters, such as the law concerning the sports broadcasting rights and the transition process to the digital terretrial televisión.
