Abstract

The ideal of a democratic society, with the presence of pluralism, implies that the greatest opportunities are given to political parties to host the most diverse aspirations. However they must respect the rules of democracy. Proven the heavy relationship between a political party and the terrorist organization ETA, the party was dissolved by the Supreme Court, decision upheld by the Constitutional Court. The European Court of Human Rights, based on its established case-law, recalled that, on the one hand it must be ensured greater choice for parties, but, on the other hand, parties must respect the essential rules of a democratic society. It analyses in detail the reasoning of the Spanish courts to conclude that they did strike a fair balance between the individual interests and the general interest.
