Abstract

The constitutional guarantee of the private property requires the judicial review of the real existence of a public utility cause to justify the expropriation of everything. The courts must review too if the taking has been limited to the strictly indispensable. The most recent sentences of the Supreme Court shown the doctrine to follow on this type of problems.
