Abstract

Since 2011 the Intellectual Property Act attributes to the Administration the power to remove content or suspend the services of the information society that involve a violation of intellectual property rights. The Sentences of the Supreme Court of May 31, 2013 are in favor of the compatibility of these new powers of the Administration with Article 117.3 of the Constitution, which reserves to judges and courts the exercise of jurisdictional power. Although sharing that conclusion, this paper aims to point out the deficiencies of the argument used by the Supreme Court, and the relative limit which the government’s regulatory power has to develop legislation on civil, procedural or, in general, not administrative matters.
