Abstract

This essay studies public procurement in the new Directives of 2014. Its adaptation in Spain requires a new Public Procurement Act. The most important matters of the new Directives are in the implementation of the principles of the public procurement: competition, integration of social and environmental considerations, research and innovation, and involvement of SMEs in public procurement. Also it is necessary to redefine the public contracts between entities within the public sector. The new Directive on the award of the concession contracts forces to reform the national regulation about the public utilities, mainly, the services concession should be different from the services contracts because the concession requires the transfer to the concessionaire of an operating risk in exploiting services. Finally, my position is to increase the competences of the Administrative Tribunals for Contractual Appeals.
