Abstract

In its SSTC 31/2010 and (especially) 18/2022 the Constitutional Court validates the Catalan autonomous regulation (art. 149.3 of the Statute of Autonomy
and arts. 20.1 b) and 30 d) of the Law of the Parliament of Catalonia 8/2020, of July 30, on coastal planning) interpreting that the autonomous competence of territorial planning includes the management of the titles of occupation of the state maritime-terrestrial public domain. In this way, the Court departs from its traditional doctrine, according to which the management of the maritime-terrestrial public domain corresponds to the State as the owner of this public domain. This change of position of the Constitutional Court raises doubts about the competences of the State regarding the management of the maritime-terrestrial public domain
