Abstract

The current study shows how Argentina, a Civil Law country, is steadily adapting some Common Law features in recent Supreme Court decisions. The Argentine Constitution provides for Social Security rights, mainly pension mobility. In the 1980s and early 1990s, inflation produced increasing judicialization. Both the Supreme Court and Congress attempted to curb lawsuits. International claims ensued. A settlement reached between the Argentine government and the Inter-American Commission on Human Rights has given ‘stare decisis’ an additional international recognition.
