Abstract

The judicial review system in the United States of America is part of the origins of its constitutional justice and the checks and balances on the constitutionality of laws. There are some rulings that are especially revealing in this sense. The importance of judicial review for control purposes and its influence can be seen in its expansion to other countries, above all in Latin America. It has been in Latin America where the possibility of judicial control over the constitutionality of laws was positi-vised, being included directly as part of the constitution, and not just channeled through jurisdictional interpretation.
