El contenido constitucional de los derechos fundamentales como objeto de protección del amparo

Abstract

It is an essential element of the constitutional process of «amparo» to protect fundamental rights. Nevertheless, such an asseveration creates new doubts that will be raise and solve using the Peruvian constitutional legal system. Thus, are the same fundamental and constitutional rights?; Which is the relation between human rights and fundamental rights?; It is the constitutional content equivalent to a fundamental right?; There exist an essential constitutional content and a not essential one?; Which are the differences with the infraconstitutional content? With a better understanding of what is the object protected by the «amparo», we will also understand the urgent protection that it has to play.
