Abstract

This paper analyses the profiles and current and prospective challenges of the Rule of Law, among which are counted the maintenance of a real democratic system, the existence of a supreme Constitution with normative force as the core international instruments on human rights, and the respect and realization of fundamental rights without unnecessary categorical distinctions that can be left out of protectoral coverage to economic, social and cultural rights or collective (or collective impact) rights. This requires a Constitutional Justice active, independent, courageous and socially legitimated, but at the same time, prudent, thoughtful, balanced and aware of its limits.
