Abstract

The public action of unconstitutionality is a procedural mechanism of individual or collective participation through the challenge related to the legality and constitutionality of constitutional reforms, normative acts, secondary or regulatory laws that are considered contrary to the fundamental text, exercised directly before the Constitutional Court. This paper seeks to describe this instrument in a general way in 14 countries within their fundamental texts and regulatory laws in its various variants, due to its importance as an instrument of constitutional regularity and social involvement in the defense of the Constitution.
