Abstract

In 2018, the Dutch Supreme Court (Hoog Rad) upheld the lower court rulings that ordered the Dutch government to reduce CO2 emissions by 25 % compared to production in 1990. This landmark ruling has been hailed as a breakthrough in climate change litigation, but has also raised concerns that it interferes with the work of the legislator. This commentary analyses the Urgenda case and some implications of global constitutionalism for some principles of constitutional justice.
