Abstract

The ordinary system of access to the judiciary has not ceased to be criticized fundamentally because the criterion of selection is limited to a memorized knowledge of the law. This paper addresses the issue and puts forward various proposals for modifying the competitive examination phase for judicial selection. The target is to improve the system so that only the most qualified can access the judiciary —or at least, the candidates arrive, technically talking, better provided. Taking into consideration
the experiences of other European countries, the proposed formulas try to help to better balance, in the exams, merits, capacities and skills that the exercise of judiciary demands.
