Disability and the Constitution: the reform of article 49 of the Constitution

Abstract

The constitutional reform of article 49 of the Spanish Constitution has led to the inclusion of the so-called social model of disability in our Supreme Norm, transforming the orientation of disability printed by the constituent Assembly in 1978. The reform, which is fundamentally correct, has been tarnished in its material articulation by a series of procedural and objective errors, including aspects that should not have been included, such as an asymmetry in favour of minors and women, and the lack of regulation of other aspects to be included in articles 3 and 14 of the Spanish Constitution.
