STC 167/2023: the limits on the Presidency of the Senate in the resolution of budgetary disputes

Abstract

The article summarizes the most innovative aspects of STC 167/2023, mainly the interpretation of art. 151.5 Standing Orders of the Senate (RS) from the perspective of the functions of the Presidency of the Spanish Senate. First, it briefly presents the regulation of the “budgetary veto” and presents the factual background of the case. Second, it explains the new hermeneutical framework of the precept and analyzes the possibility of the vetoing “propuestas de modificación” in the Senate. Finally, we reflect on the need for a ruling from the Constitutional Court in relation to the declaration of nullity of votes, we study the compatibility of the resolution with previous jurisprudence and the lack of protection of parliamentarians in the current context.
