Abstract

The existing debate on double prejudice is transformed and enriched with the new advisory opinion procedure that can be raised in relation to the Strasbourg Court if the Kingdom of Spain signs the corresponding protocol. In this text we show the different options ordering the proceedings dealing with the topic in some nearby States (France and Italy) and the ones studied by the expertise. We propose a coherent model that allows the coexistence of those ones within the Spanish model (constitutionality action).
