Abstract

The renewal of the General Council of the Judiciary is a recurring problem, as it has not occurred on time since its creation. Among other factors, the blockade exerted by political parties contributes to this, in particular when they do not agree on the appointment of its members. One of the anti-blockade measures has been the one introduced by Organic Law 4/2021, March 29, which establishes a legal regime for the Council in office, limiting some of its powers. This work critically analyzes this legal measure and the content of STC 128/2023, October 2, which declares it constitutional.
