The amnesty of the procés before the Venice Commission

Abstract

In March 2024, the Venice Commission approved an Opinion on the Proposal of Organic Law on amnesty for institutional, political and social normalization in Catalonia. In this paper, a critical analysis of the report is carried out. After a brief introduction (1) and a delimitation of its scope (2), the author succinctly examines the criticisms of lack of definition it contains, as well as the procedural problems it identifies (3). He then goes on to focus on the most serious considerations of the Commission, the corollary of which is a general, albeit implicit, disqualification of the initiative (4). Some critical observations to the Opinion are also added, both regarding its form and its substance (5), before closing the article with a brief section of conclusions (6).
